Welcome to www.peekme.to ("PeekMe", "Platform", "Website", "Service", "we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of the PeekMe website, products, services, content, features, and functionality.

By accessing or using PeekMe, creating an account, uploading content, browsing the Platform, or otherwise using any part of the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

1. Nature of the Platform

PeekMe is a user-generated content platform that allows users and creators to publish preview content, profile information, pricing references, and links to third-party websites and platforms.

PeekMe is designed as a promotional preview and discovery layer for creators. The Platform may display teaser previews, profile pages, creator-related information, and outbound links to third-party platforms where creators may offer paid or subscription-based content.

PeekMe does not operate as the merchant of record for third-party creator subscriptions sold on external platforms. Unless expressly stated otherwise, PeekMe does not sell, license, distribute, or deliver full third-party premium content hosted outside the Platform.

PeekMe may host preview materials uploaded by users or creators. All such content is submitted at the sole responsibility of the user who uploads it.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is higher, to access or use PeekMe.

By using the Platform, you represent and warrant that:

you are at least 18 years old;
you have the legal capacity to enter into a binding agreement;
you will comply with these Terms and all applicable laws and regulations.

If you do not meet these requirements, you must not use the Platform.

2a. Age-Restricted Content

Certain content on the Platform is restricted to users who are at least 18 years old. Access to such content requires age verification, during which you will be asked to confirm your date of birth.

You are solely responsible for the accuracy of the date of birth and any other information you provide. By submitting your date of birth, you confirm that the information is truthful and accurate. PeekMe relies on this self-declaration in good faith and accepts no liability for false or inaccurate age information provided by any user.

If you are under 18 years old, you must not attempt to access age-restricted content on the Platform.

3. Adult Content Warning

PeekMe may contain adult-oriented, sexually suggestive, or explicit preview material, including content associated with adult creators and adult-focused third-party platforms.

By accessing the Platform, you acknowledge and agree that:

you may be exposed to adult content;
you do so voluntarily and at your own risk;
you are legally permitted to access such material in your jurisdiction;
you are solely responsible for ensuring that access to the Platform is lawful where you are located.

We reserve the right to restrict, hide, age-gate, label, remove, or otherwise control access to any content in our sole discretion.

4. User Accounts

Certain features of the Platform may require account registration. When creating an account, you agree to provide accurate, current, and complete information and to keep such information updated.

You are solely responsible for:

maintaining the confidentiality of your login credentials;
all activities occurring under your account;
ensuring that your account is not used by any other person without authorization.

You must notify us immediately if you suspect unauthorized access, misuse, or a security breach related to your account.

We reserve the right to suspend, restrict, or terminate your account at any time, with or without notice, for any reason or no reason, including where we suspect violation of these Terms, abuse of the Platform, fraud, legal risk, reputational risk, copyright complaints, payment risk, or safety concerns.

5. Creator Accounts and Creator Responsibility

If you use the Platform as a creator, uploader, publisher, or other content contributor ("Creator"), you assume full legal and practical responsibility for all content, metadata, links, pricing references, promotional materials, and other information you submit or make available on the Platform.

By uploading or publishing any content, you represent, warrant, and agree that:

you own the content, or you have all necessary rights, licenses, permissions, and authority to upload, display, distribute, and promote it on PeekMe;
the content does not infringe, violate, misappropriate, or otherwise conflict with any copyright, trademark, privacy right, publicity right, contract right, or other right of any third party;
the content is lawful in all relevant respects;
all persons appearing in the content are real adults who were at least 18 years old at the time the content was created;
where required, you possess valid age and identity verification records and all necessary consents, releases, and documentation;
the content is not deceptive, fraudulent, misleading, unlawful, abusive, exploitative, defamatory, or harmful;
you will not upload content obtained without consent, stolen content, leaked content, pirated content, or content taken from other platforms without authorization;
you will comply with all applicable laws, regulations, platform standards, and any content policies we may publish or enforce from time to time.

You remain solely responsible for maintaining copies, records, proof of ownership, proof of consent, and any legally required documentation related to your content.

6. Prohibited Content and Conduct

You may not use the Platform to upload, publish, transmit, distribute, promote, or otherwise make available any content or activity that:

is unlawful, misleading, fraudulent, defamatory, abusive, threatening, or harassing;
infringes any copyright, trademark, privacy, publicity, contract, or other rights of any person or entity;
contains child sexual abuse material, exploitative material, non-consensual sexual content, deepfake abuse, revenge porn, or any other prohibited sexual content;
depicts or promotes minors in any sexualized or age-inappropriate context;
contains violence, coercion, trafficking, bestiality, incest, or any unlawful or exploitative conduct;
contains malware, spyware, phishing, scams, spam, bots, scraping tools, or harmful code;
attempts to manipulate views, likes, rankings, credits, payouts, or creator statistics through bots, scripts, fake traffic, automated systems, click farms, multiple accounts, or deceptive activity;
impersonates another person or misrepresents identity, affiliation, ownership, or authority;
collects or harvests user data without authorization;
interferes with the security, integrity, performance, or proper functioning of the Platform.

We may determine, in our sole discretion, whether content or conduct is prohibited.

7. Content Review and Enforcement

We are not obligated to monitor all content, accounts, or activity on the Platform. However, we reserve the right, at any time and in our sole discretion, to investigate, review, moderate, remove, restrict, demonetize, downrank, hide, disable, edit, or refuse any content, account, link, or activity.

We may take such action with or without prior notice and with or without explanation.

We may also preserve, review, and disclose information where reasonably necessary to:

enforce these Terms;
comply with legal obligations;
respond to legal claims or complaints;
protect the rights, property, safety, or reputation of PeekMe, our users, third parties, or the public.

8. User-Generated Content License

You retain ownership of content you upload, subject to the rights you grant to us under these Terms.

By uploading, publishing, or otherwise making content available on the Platform, you grant PeekMe a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, cache, reproduce, process, adapt, display, publish, distribute, transmit, promote, market, format, compress, create thumbnails from, and otherwise use such content for the operation, improvement, promotion, security, moderation, and administration of the Platform.

This license includes the right to display your content on profile pages, preview pages, listings, feeds, recommendations, search results, promotional placements, featured sections, internal rankings, social snippets, marketing creatives, and similar contexts related to the Service.

This license continues for as long as reasonably necessary to operate the Platform and to maintain backup, archival, legal, safety, fraud prevention, or compliance functions, even if content is later removed from public display.

9. External Platforms and Third-Party Links

The Platform may include links, redirects, embeds, references, profiles, usernames, pricing references, discount references, and other information relating to third-party platforms, including subscription platforms, creator platforms, social platforms, payment providers, and other external services.

PeekMe does not own or control such third-party services and is not responsible for:

their content;
their pricing;
their subscription terms;
their billing practices;
their privacy or security practices;
their legality, accuracy, availability, or reliability.

Any transaction, subscription, payment, communication, dispute, refund request, or interaction between you and any third-party platform is solely between you and that third party unless expressly stated otherwise.

Your use of any third-party service is at your own risk and subject to that third party's own terms and policies.

10. Credits System

PeekMe uses a credits systemy. Credits are a limited-purpose internal platform feature and do not constitute stored value, electronic money, bank deposits, securities, investment products, property rights, or legal tender.

Unless expressly required by applicable law, credits:

have no cash value outside the Platform and may only be redeemed for cash through the Platform's designated conversion feature, subject to eligibility conditions and our sole discretion;
are non-transferable unless expressly permitted by us;
are non-refundable unless expressly required by law or expressly stated by us;
may be modified, cancelled, withheld, expired, adjusted, reversed, or forfeited at any time in accordance with these Terms, the Platform rules, fraud checks, or operational requirements.

We reserve the right to determine, change, limit, suspend, or discontinue at any time:

how credits are earned;
how credits are displayed;
minimum thresholds;
eligibility conditions;
conversion rates;
withdrawal methods;
fees, deductions, holds, verification requirements, and anti-fraud controls.

Current creator conversion conditions, thresholds, and rates may be displayed within the creator profile area or other designated section of the Platform. Such conditions may be changed by us at any time, with immediate or future effect, subject to applicable law.

11. Creator Earnings, Payouts, and Conversion of Credits

Where available, creators may be allowed to convert eligible credits into money, subject to the conditions then in effect on the Platform.

Any payout, conversion, withdrawal, redemption, or similar feature is subject to:

minimum eligibility thresholds;
account verification requirements;
completion of the creator's profile with accurate personal information and a valid PayPal account, as required in the account settings;
identity checks;
fraud prevention review;
compliance review;
tax and legal review where applicable;
technical availability;
our discretion to suspend, delay, reject, reverse, or investigate suspicious activity.

We do not guarantee that any creator will earn any minimum amount, receive any specific level of traffic, achieve any particular conversion rate, or receive any payout within any specific timeframe.

We may withhold, delay, reduce, cancel, reverse, or permanently deny credits or payouts where we suspect or determine, in our sole discretion, that:

traffic is invalid, artificial, incentivized in a prohibited way, fraudulent, low quality, or manipulated;
content violates these Terms or applicable law;
ownership, identity, age, consent, or rights cannot be satisfactorily verified;
there is a chargeback, complaint, rights dispute, compliance issue, or safety concern;
an account is associated with abuse, spam, gaming of the system, or reputational risk.

We may require creators to provide invoices, tax information, identity documents, payment details, address confirmation, or other supporting records before processing any payout.

12. No Guarantee of Results

PeekMe is a platform for discovery, previews, promotion, and creator visibility. We make no promise or guarantee regarding views, clicks, exposure, ranking, discoverability, conversion, subscriber growth, earnings, or commercial performance.

Any statistics, rankings, recommendations, featured placements, badges, trend labels, creator analytics, visibility tools, or similar metrics are provided on an "as is" and "as available" basis and may be approximate, delayed, incomplete, filtered, adjusted, or changed at any time.

We may modify ranking algorithms, recommendation systems, featuring logic, content visibility rules, and anti-fraud systems without notice.

13. Fees, Charges, Taxes, and Payment Providers

Some features of the Platform may involve payments, purchases, paid boosts, credits, premium functionality, or creator-related conversion features. You agree to pay all applicable fees, charges, taxes, and payment-related amounts associated with your use of such features.

You are solely responsible for:

all taxes, reporting obligations, and legal compliance arising from your earnings, transactions, or use of the Platform;
ensuring that your payment and payout details are accurate and up to date;
any fees charged by payment processors, banks, card issuers, intermediaries, or third-party providers.

We may use third-party payment processors and do not control their independent actions, policies, processing times, or decisions.

14. Intellectual Property of the Platform

Except for user-generated content and third-party materials, all elements of the Platform, including its software, structure, design, layout, branding, text, graphics, logos, icons, interfaces, databases, compilations, and functionality, are owned by or licensed to PeekMe and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, scrape, republish, reverse engineer, extract, distribute, sell, license, exploit, or create derivative works from the Platform or its proprietary materials except as expressly permitted by us in writing.

15. Copyright Complaints and DMCA

If you believe that content on the Platform infringes your copyright or other rights, please review and use our DMCA Copyright Policy and takedown procedures.

We may remove content, disable access, or terminate accounts in response to intellectual property complaints, repeat infringement, or other legal risks.

16. Privacy

Your use of the Platform is also subject to our Privacy Policy, which describes how we collect, use, store, and disclose personal data and technical information.

By using the Platform, you acknowledge that data processing may occur in accordance with our Privacy Policy.

17. Disclaimer of Warranties

To the maximum extent permitted by law, the Platform and all related services, content, features, tools, statistics, and materials are provided on an "as is", "as available", and "with all faults" basis.

PeekMe disclaims all warranties, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, compatibility, security, uninterrupted access, or error-free operation.

We do not warrant that:

the Platform will always be available, uninterrupted, secure, or error-free;
content will be accurate, complete, lawful, authentic, or non-infringing;
statistics, rankings, or analytics will be precise or suitable for any decision-making purpose;
any defect, bug, security issue, or vulnerability will be corrected;
the Platform will meet your expectations, business goals, legal needs, or commercial objectives.

18. Limitation of Liability

To the maximum extent permitted by law, PeekMe, 4INTERNET, s.r.o., and their directors, officers, employees, contractors, affiliates, agents, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or similar damages, including without limitation loss of profits, loss of revenue, loss of goodwill, loss of business opportunity, loss of data, reputational harm, service interruption, account suspension, or content removal, arising out of or related to:

your use of or inability to use the Platform;
user-generated content;
adult content exposure;
third-party links or platforms;
creator disputes;
credit balances, adjustments, forfeitures, or payout issues;
errors, bugs, outages, security incidents, moderation decisions, or enforcement actions.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Platform shall not exceed the greater of:

the amount you paid directly to PeekMe, if any, during the three (3) months preceding the event giving rise to the claim; or
one hundred euro (EUR 100).

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

19. Indemnification

You agree to defend, indemnify, and hold harmless PeekMe, 4INTERNET, s.r.o., and their directors, officers, employees, affiliates, contractors, agents, licensors, and service providers from and against any and all claims, allegations, actions, proceedings, liabilities, damages, losses, judgments, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to:

your content;
your use of the Platform;
your violation of these Terms;
your violation of any law or regulation;
your infringement of any rights of any third party;
any dispute between you and another user, creator, rights holder, payment provider, or third party.

20. Suspension, Termination, and Content Removal

We may suspend, restrict, terminate, remove, or disable your account, content, credits, visibility, creator features, payout eligibility, links, or access to the Platform at any time, with or without prior notice, for any reason or no reason, including suspicion of risk, abuse, infringement, fraud, chargebacks, legal complaints, or violation of these Terms.

Upon termination, rights granted to you under these Terms will cease immediately. Certain provisions of these Terms shall survive termination, including provisions relating to licenses, disclaimers, liability limits, indemnification, dispute-related matters, and enforcement rights.

21. Changes to the Platform

We reserve the right to modify, suspend, discontinue, redesign, restrict, or remove any part of the Platform, any feature, any category of content, any earning mechanism, any creator tool, any payout model, any ranking logic, or any business rule at any time.

We shall not be liable for any such modification, suspension, or discontinuation.

22. Changes to These Terms

We may update or modify these Terms at any time. The updated version will become effective when posted on the Platform, unless otherwise stated.

Your continued use of the Platform after updated Terms are posted constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Platform.

23. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts of the Slovak Republic, unless mandatory law provides otherwise.

Notwithstanding the foregoing, consumers residing in the European Union retain the right to invoke the mandatory consumer protection provisions of the law of their country of residence, and to bring claims before the competent courts of that country, to the extent such rights cannot be waived under applicable law.

24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

25. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.

26. Entire Agreement

These Terms, together with any policies expressly incorporated by reference, including the Privacy Policy and DMCA Copyright Policy, constitute the entire agreement between you and PeekMe regarding your use of the Platform and supersede any prior or contemporaneous understandings, communications, or agreements relating to the same subject matter.
